Gina Rinehart’s children can now claim their share of the family’s multimillion-dollar trust, after Australia’s richest person unexpectedly brought forward the vesting date of the disputed fund.

Andrew Bell SC, for Ms Rinehart’s three eldest children, told the court on Wednesday that last week she had amended the trust to advance the vesting date from 2068 to “such as the trust has now vested”.
AAP understands this means the children can now call for their shares in the family company Hancock Prospecting Windows Vista Key, but that step could involve tax consequences.
They would also be entitled to dividends should the company decide to issue them.
Their billionaire mother controls 75 per cent of the company.
Last September, John Hancock, Bianca Rinehart and Hope Welker launched their lawsuit against their mother in a bid to oust her as trustee of the multibillion-dollar family trust.
They said she contacted them in early September 2011, days before her youngest child, Ginia, turned 25, when the trust was due to vest.
The iron ore magnate warned them the vesting of the trust on September 6 would render them liable for a substantial amount of capital gains tax and lead to their bankruptcy.
To avoid financial ruin, they should sign a new deed giving her long-term control, she said.
The three children alleged their mother had acted with “gross dishonesty” and “deceitfully” in her dealing with the trust and had secretly changed the vesting date of the deed to 2068.
On Wednesday, Mr Bell called for access to the document Ms Rinehart relied on in her September letter in relation to the capital gains tax.
During legal argument on the issue Office Stand-Alone Programs, Justice Paul Brereton said, “It cannot be suggested the parties in this matter should be able to infinitely occupy the time of the court.
“It is quite evident that, if allowed, every point will be taken along the way.
“As far as possible I am going to stop that.”
The children are continuing their action against their mother, and the matter will be back before Justice Brereton on July 13.
Televangelist Joel Osteen prayed for Congress today, asking for God to show “your goodness and your favor to the United States of America and to those who govern it,” but he also told ABC News that he believes members of Congress should be more willing to compromise.

Asked whether he has ever considered running for public office, Osteen said that he is happy with his current profession.
“I feel called to do what I’m doing now, and I never really have [thought about running],” he said. “I just feel blessed to be doing what I’m doing and just pray for those that do enter this world [of politics].”
Osteen has meetings in Washington through Thursday, including a private meeting with House Speaker John Boehner, a private get-together with Sen. Marco Rubio, R-Fla., and another event with the congressional delegation representing Houston Wednesday evening.

Donald Trump swept theatrically into the Scottish Parliament in Edinburgh intent on halting construction of a pioneering offshore wind turbine test centre near his controversial golf course, north of Aberdeen. But faced with the polite, persistent questioning of Members of the Scottish Parliament (MSPs), Trump visibly ran out of steam. It was no McKnockout – but the American billionaire certainly lost on points. Now it remains to be seen if his £750 million plans for a hotel, leisure complex and housing will ever go ahead and if the “best course in the world” – will open as planned on 10 July this year.
A dozen cross-party members of the Scottish Parliament’s Economy, Energy and Tourism Committee had taken their seats before a capacity audience of press, public, photographers and cameramen when the distinctively coiffed Trump entered Committee Room One. Swaggering like a well-dressed prize fighter The Donald surveyed the room with a combative grin, flanked by dark-suited minders including son Donald Junior and manager George Sorial.
After several provocative TV and radio interviews, the audience was waiting with bated breath for “new and extra” information about promises allegedly made to Trump by erstwhile supporter Alex Salmond. But though James Murdoch landed a blow on the SNP leader at the Leveson Enquiry earlier this week Tattoo Inks, Trump’s follow-up punch failed to materialise. Is it possible Alex Salmond was actually paying him?
Indeed an MSP cited an opinion poll which showed more than 90% of the public were more likely to back wind power as a result of Trump’s recent conduct and comments. Trump replied with gusto that it was easy to concoct a good result – after all an opinion poll conducted for the Trump Organisation had found 93% backing for his plans. Was that really what he meant to say?
Discussion focussed on the impact of wind turbines on tourism. A few days ago, VisitScotland published poll findings that 80% of the public would not change their holiday decisions because of wind farms. Nonetheless, Trump argued turbines are “so unattractive and so ugly you’ll lose your tourism industry completely.”
What about the golf course at Royal St George’s in England – another MSP asked. It’s been flanked by a coal fired power station and wind turbine for many years and still pulls in Championship events.
Was there any evidence the pulling power of the course had been damaged? Trump changed the subject. Another MSP pointed out that in the northern Orkney Islands 100% of energy is produced by onshore wind turbines – yet Orkney visitor numbers are growing faster than the UK average. Trump replied that he knew nothing about Orkney and that these must be “appropriately sited” turbines.
If anyone was looking for a killer blow on either side it plainly wasn’t going to happen.
Then Trump moved onto the promises made by former First Minister Jack McConnell. He said the Labour First Minister had assured him turbines would always be vetoed around the oil capital because of possible interference with radar and shipping lanes. That “assurance” was why he had chosen to build his course in Aberdeenshire in preference to Ireland or his “native” Hebridean Lewis.
So was Trump misled? MSPs pressed the hotel-magnate with evidence of dates. The test centre for offshore turbines had been proposed in 2002 and 20 public consultation meetings held before Trump bought the Menie Estate in 2006. A month later Trump was describing the wind project as a “deal killer” and yet he had already bought the land.
All eyes turned to Trump but… he changed the subject again.
“Phoney and totally random targets in Scotland cannot fight climate change because China is decimating the atmosphere. Scotland is 20 years behind the times because wind farms are being abandoned all over the world.” Never mind that Bill Gates is urging the US to invest massively in renewables while they still can.
Faced with a list of Scottish companies investing in renewables, Trump insisted all new jobs were going to China. Faced with the fact all energy sources are subsidised (fossil fuels get £3.7 bn against renewables £1.4bn) Trump said wind turbines are falling to pieces and will have to be replaced every five years.
It was like being in a parallel universe.
So what’s the conclusion? Wind energy will continue to divide Scots. Donald Trump’s appalling high-handed behaviour towards local Scots on “his estate” – a subject not raised today – will continue to unite Scots against him. Hollywood came and Hollywood left. Meanwhile, the modest, planet-saving business of trying to produce affordable, sustainable energy in Scotland continues.

Today’s jobs report: Good news or bad news? Depends on whom you talk to.
While the report from the Department of Labor shows that 120 Tattoo Kit,000 jobs were added in March, those jobs were far below the number added in January and February and missed the target number of additional jobs that forecasters expected. In addition, the unemployment rate dropped slightly to 8.2 percent.
Republican Presidential candidate Mitt Romney expressed worry over the jobs report and said the decreased unemployment rate reflected discouraged workers exiting the job search. Romney released a statement today saying the jobs report is “weak and very troubling” and “shows the employment market remains stagnant. Millions of Americans are paying a high price for President Obama’s economic policies, and more and more people are growing so discouraged that they are dropping out of the labor force altogether. It is increasingly clear the Obama economy is not working and that after three years in office the President’s excuses have run out.”
Obama “welcomed” today’s news from the jobs report and said, “Right now, no issue is more important than restoring economic security for all our families in the wake of the greatest economic crisis since the Great Depression,” at today’s White House Forum on Women and the Economy. The White House said the report provides “further evidence that the economy is continuing to recover.”
But the White House was was cautious in taking too much stock in the report’s indicators. ”Monthly employment and unemployment figures can be volatile,” the White House said in the statement. “It is important not to read too much into any one monthly report.” During the forum, the president qualified the good news again, saying, “it’s clear to every American that there will still be ups and downs along the way, and that we’ve got a lot more work to do.”
Chairman of the Council of Economic Advisers Alan Krueger wrote in a White House blog that more action is needed to keep up momentum toward economic recovery. “It is critical that we continue to make smart investments that strengthen our economy and law a foundation for long-term middle class job growth so we can continue to dig our way out of the deep hole that was caused by the severe recession that began at the end of 2007,” Krueger wrote. “Despite adverse shocks that have created headwinds for economic growth, including weak construction investment The Best Tattoo Machines, the economy has added private sector jobs for 25 straight months, for a total of 4.1 million jobs over that period.”

Shortly after 1 o’clock this morning, the Virginia House of Delegates proved that it can indeed be as mean-spirited and parochial as its detractors at Comedy Central have come to expect. By a slim margin, the House voted to kill the judicial nomination of an openly gay Richmond prosecutor who had bipartisan support going into the vote. A last-minute lobbying effort by the very same social conservatives who pushed unsuccessfully to mandate “medically unnecessary trans-vaginal ultrasounds” this past spring, successfully killed Tracy Thorne-Begland’s bid for a judgeship, based on claims that his 20 years of “activism” on gay rights issues made him unfit to sit on the bench.
Thorne-Begland won only 33 votes of the 51 he needed to win the judgeship. Thirty-one delegates voted against him, and many abstained. He was the only candidate voted down. The only issues on which Thorne-Begland was challenged were his same-sex partner and his gay rights activism. There wasn’t even a claim that he was unfit for any reason other than who he is and what he has fought for.
As was the case with the ultrasound bill, Virginia Gov. Robert F. McDonnell tried to tamp down the bigotry on display in the House by pointing out several hours before the vote that a judicial nominee’s sexual orientation should simply not be an issue in a state that claims not to discriminate. In a statement, his spokesman said, “The Governor believes candidates for judicial vacancies must be considered based solely on their merit, record, aptitude and skill. No other factors should ever be considered and the Governor has long made clear that discrimination on the basis of sexual orientation is not acceptable in state government. ” It fell on deaf ears in a state that apparently believes sexual orientation is in fact the best reason to discriminate.

Republican Del. Robert Marshall, who led the charge against Thorne-Begland, faulted the former Navy officer for speaking out publicly—over 20 years ago—against the “Don’t Ask, Don’t Tell” policy. (Marshall described this as not mere insubordination, but also a waste of taxpayer money. “The Navy spent $1 million training him,” Marshall said. “That’s cheating the country out of the investment in him.”) Marshall further faulted Thorne-Begland for “holding himself out as married,” since gay marriage is illegal in the Commonwealth of Virginia. To Marshall, the fact that Thorne-Begland lives in perpetual conflict with the state Constitution would infect and inform his every judicial act—even though the proposed judgeship would have placed Thorne-Begland on the General District Court, the lowest court in Virginia, where no gay rights issue would ever be likely to come before him. And Thorne-Begland has gone so far as to state in writing that he would recuse himself on any issue in which he had a conflict. But that still wasn’t good enough for the commonwealth. Because in Virginia, the only way to be sure that there is no discrimination from judges is by discriminating.
Peeling away all the circular logic, it would seem that to Marshall and to his allies in the conservative Family Foundation, Thorne-Begland’s principal disqualification is that he has been a “homosexual activist.” (“I don’t even think it’s proper to put his name forward because of his behavior,” said Marshall.) Marshall then went on to clarify that it is OK for elected officials to have served in advocacy roles, pushing for say, unconstitutional personhood legislation deeming that life begins at conception, but advocacy of any sort is not appropriate for future judges, who must apparently be impartial from birth to swearing-in.
What cost Thorne-Begland the nomination is all the discriminatory rules he has challenged. He famously appeared on Nightline challenging DADT in 1992. (He was honorably discharged.) Of course by that yardstick, Justice Thurgood Marshall—dubbed the “suicidal crusader” at the NAACP—was also unfit to serve as a judge. So was Ruth Bader Ginsburg, a passionate career-long advocate for women’s rights. Indeed by that measure almost every lawyer who has advocated passionately for any client or cause or change in existing law—from Janice Rogers Brown to Clarence Thomas to the brilliant Paul Clement—is also unfit for the bench. Apparently, the only advocates we can trust to morph into a neutral umpire upon rising to the bench are straight white men. Anyone else who pledges to become an umpire—as Thorne-Begland did, by the way—must be lying.
Thought experiment: If a decorated former Navy pilot and law-and-order prosecutor who loved his two children and devoted 20 years to the fight to restore school prayer had come up for a vote this morning, would Del. Marshall be questioning his integrity and character? Or pushing for a Supreme Court slot?
It should terrify anyone who cares about the future of the judiciary that advocacy Discount Hale Bob Dresses, especially passionate advocacy, and most especially passionate advocacy on civil rights issues with respect to laws that have since been repealed, can be disqualifying. Or at least it can be disqualifying when that zealous advocacy is for a cause about which elected officials have personal religious objections.
Thorne-Begland didn’t challenge DADT because he wanted to embarrass the military. He challenged it because he is braver than the rest of us. When he and his fellow pilots stationed at Virginia Beach were told that in a 20-year career, approximately 25 percent of them would be killed in action Chanel Dresses sale, he realized that he would die for his country but he wouldn’t lie for it. Integrity, it seems, is only rewarded when you tell the right kinds of lies. Thorne-Begland has been a well-respected state prosecutor for 12 years and was the unanimous choice of the Democrats and Republicans in the Richmond delegation, who advanced his nomination. He was approved by the courts committees in the House and Senate. The attacks on him began only after that vetting process was complete. His career-long advocacy of gay rights issues crossed some invisible line when, as the Family Foundation breathlessly warned, Thorne-Begland had the temerity to actually be “with President Obama when he signed the repeal of DADT.”
If we keep refusing to seat any judges who stand up to discrimination, Virginia will continue to be a state that discriminates. And if we only want to seat judges willing to lie about who they are and what they believe in, we may as well stop seating judges at all.

When, exactly, was it decided that blue would be the new color for hi-tech? Because I wasn’t invited or even informed. And it’s not just the color, it’s right there in the name, so even the colorblind can get on board. Well we can’t answer the second part, but as far as we can tell, the name is being applied to Mercedes-Benz’ latest blue-green powertrain, running on compressed natural gas and featuring start-stop functionality.
The CNG engine is found in the new Mercedes-Benz B170 NGT BlueEfficiency (yeah, we’re done with the all-caps) Tattoo Supplies, the headline model on the newly facelifted Mercedes B-Class. The updated B, which succeeds the model that has been on the market for three years now, benefits from a redesigned front end – encompassing a new grille, front bumper and hood – plus new taillights, rear bumper and an updated interior. A new variety of wheels are available as well, while the wing mirrors, door handles and door sills are now painted to match the body color. The facelift should hold the B-Class until Mercedes replaces it altogether, but since it’s still not available in the United States, you’ll have to head north to Canada or overseas to see one in person.
